Fair Use Policy

Access to and use of this Website and the products and services available through this Website (collectively, the "Services") are subject to this Fair Use Policy. This Fair Use Policy governs your use of the Services provided by Tuilder and available through tuilder.com and affiliate sites. This policy applies to anyone ("Customer") using the Services.

The Services shall be used for lawful purposes only. Transmission, display, data collection or storage of any material or data in violation of applicable laws of regulations, including without limitation to the laws of the Commonwealth of Australia, is prohibited. Tuilder reserves the right to terminate and refuse Services to any Customer who uses the Services unlawfully, exposes Tuilder to liability or threatens its ability to provide services to other customers.

You agree to hold Tuilder harmless and to indemnify it from any claims resulting from your use of the Services.

Extreme Usage

Whilst we provide our services without strict resource limit, at times users who use significantly more resources and who compromise other users of the service may fall under the category of "Extreme Usage".  This may result in the termination of your account, usually with prior notice and negotiation. 

Extreme usage is that which compromises other users of the service in terms of server resources (disk space, memory, processing power etc.). Examples of this may include, but is not limited to:

  • Excessive Gigabytes (GB) of email storage
  • Excessive GB of media storage (images, files, etc.)
  • Excessive GB of monthly bandwidth
  • Excessive amounts of emails sent

In the majority of cases, we will contact you to notify you of excess service usage before taking action against your account. We will also offer a custom package and rate which you will either need to pay in order to continue use of the service, or scale back your usage of resources.

Prohibited Uses

You must not use the Services to publish content or engage in activity which is harmful to others or that is illegal under applicable law. This includes, but is not limited to:

  • Disclosing private, or sensitive information about other people
  • Distributing malicious software
  • Unlawful distribution of controlled substances (e.g. tobacco, alcohol, drugs, etc.)
  • Unlawful distribution of prescription medications.
  • Gambling
  • Pornographic material
  • Hosting exchange related, MLM schemes, or Ponzi related sites;
  • Hosting or linking to a website intended to mislead the public
  • Linking to or hosting a proxy server
  • Infringing upon the Intellectual Property Rights of others
  • Identity theft
  • Money laundering
  • Sale of weapons or ammunition

Zero Spam Tolerance

Tuilder has a zero spam tolerance policy for use of its Services to send unsolicited bulk or commercial e-mail. 

Defamation, Hate-speech, Objectional Content

Tuilder respects the right to freedom of speech and that the internet provides an open forum for the discussion and dissemination of information. We do not, as a general rule, screen or monitor customer content. However, if any content violates law or is defamatory or objectionable in nature, we maintain the right to take appropriate action at our discretion to prevent harm to others.

Enforcement

Tuilder may terminate your Services with or without prior notice upon any violation of this Fair Use Policy.
